Please read carefully the terms and conditions provided below (hereinafter the “Terms”) that govern your use of the Shared Expenses feature (hereinafter the “Product”). By using the Product, you fully agree to these Terms.
1. Description of the Product
1.1. Shared Expenses is a digital service provided by TBC Bank JSC (ID 204854595) hereinafter the “Bank”) that allows customers to split group payments/bills efficiently and settle them from a single pool.
1.2. The Shared Expenses feature in Mobile Bank:
1.2.1. Enables customers to collect payment shares from transaction participants easily and efficiently via digital bank;
1.2.2. Allows members of a Shared Expense Group, once created, to make recurring payments to one another without manually setting up a payment order each time.
2. Terms of Use
2.1. The Product is managed by members of the Shared Expense Group, which unites Mobile Bank users, excluding legal entities.
2.2. Shared Expense Group members have equal rights: they can add or remove participants, split expenses among themselves, etc.
2.3. New members may be added to the Shared Expense Group at any time. Users are encouraged to add new members thoughtfully and invite/admit only those who are who will participate in the shared expense.
2.4. A Mobile Bank user can create a group and invite other users to join. New members can join the group by scanning a QR code or using a link shared through various communication channels.
2.5. Group members can leave the group at any time, or remove any other member as needed.
2.6. Each member can contribute their share to the expenses pool, view the shares contributed by other members and/or adjust the shares as necessary
2.7. The Customer may initiate payment collection by inviting the entire group or only those members who participated in the payment.
2.8. In their profile, the Customer can track how much they owe or are owed by other members.
2.9. While initiating a payment, the Customer selects a group member, identifies the account, and confirms the transfer.
2.10. The number of group members is not limited.
2.11. Customers/group members are not permitted to create/use/join a group and/or share expenses related to unlawful or unethical conduct, instigation of violence and/or offence, purchase of illicit goods (weapons/firearms, drugs and/or other goods banned from sale and purchase under applicable law).
2.12. The restriction set forth in 2.11 above fully applies to group labels and profile images.
2.13. In case of violation of the requirements and rules envisaged herein, the Bank reserves the right to unilaterally take relevant steps (including cancellation of the group).
3. Confidentiality and Privacy Statement
3.1. The Bank represents that it manages confidential information and personal data in accordance to the Privacy Policy published on the Bank’s website https://tbcbank.ge/ka/privacy-policy. By agreeing to the Terms hereunder, the Customer confirms that they are aware of and agree to the aforementioned Privacy Policy.
3.2. By agreeing to these Terms, the Customer confirms that after joining the group, their information, including the initials of their first and last name, their user profile image in Mobile Bank (Avatar), shared transaction details (merchant name, transaction amount, currency and transaction date), the amount of their share and its payment status (whether paid or unpaid) will be accessible to other group members. Furthermore, the aforementioned details/information will also be accessible to those group members who did not participate in the given payment.
3.3. The Customer is aware that the group’s profile image will be displayed to all group members, including those who have been invited but not yet accepted into the group. The Customer agrees not to display a photo that contains/depicts violence and discrimination, suggests a breach of ethical standards and/or constitutes infringement of third-party rights either directly or indirectly. Furthermore, the use/display of the photo must not be in violation of the Georgia law on Copyright and Neighbouring Rights;
3.4. It is prohibited to share group members’ confidential information and/or personal data with third parties and use/process them beyond the intended purpose of the Product.
3.5. By accepting the Terms set forth herein, the Customer represents that they will use the confidential information and personal data pertaining to the group solely for the purpose of the Shared Expenses feature and will observe the provision set out in 3.2 above.
3.5.1. If the Customer does not wish to share their personal data with other group members, they shall leave the group.
4. Responsibilities
4.1. The Bank, on its part, will support provision of the service hereunder to the Customer via Mobile Bank.
4.2. The Bank shall not bear responsibility for any direct or indirect, intended or unintended, or consequential damage resulting from unlawful use of the Product and violation of the Terms described herein.
4.3. The Bank does not intervene in expense distribution, affordability and the group members’ financial commitments. It only ensures consistent structure and organization of transaction records in Mobile Bank.
5. Other Terms
5.1. These Terms are governed by the Georgian Law and the Agreement on Banking Transactions executed by and between the Parties.
5.2. The Product may only be used lawfully and for its intended purpose.
5.3. The Customer shall not use the Product for unlawful and fraudulent purposes, and/or to the detriment of the Bank and/or the group members.
5.4. The Bank reserves the right to amend these Terms and Conditions at any time.
